What is the R&D tax incentive and how much can I receive?

Australia’s R&D tax incentive offers a refundable cash rebate of up to 43.5 % (or a non-refundable offset for larger groups) on eligible R&D expenditure.

Who can claim the incentive?

Any incorporated Australian entity, including subsidiaries of foreign-owned entities, that undertake eligible R&D activities for commercial benefit may apply.

What are the key steps and timing?

  1. Conduct R&D during the income year.
  2. Register activities with the Department of Industry, Science & Resources within 10 months of year-end.
  3. Lodge the company tax return including the R&D amount.

Is there a minimum spend?

Yes. You must incur at least $20,000 of eligible R&D costs in the year (unless using an approved registered Research Service Provider).

Which activities qualify as ‘eligible R&D’?

Work that aims to create new knowledge, is based on technical uncertainty and hypotheses, involves systematic experimentation, and is documented contemporaneously. Marketing, commercial research and social-science projects are excluded.

Can I claim founder time or unpaid 'sweat equity'?

No. Only paid, third-party or employee costs actually incurred and recorded can be claimed; unpaid contributions are ineligible.

How are related-party or overseas costs treated?

Related-party payments must be paid in cash before year-end. Overseas subcontractor costs are excluded unless an Advanced Finding is lodged before the end of the income year – and subsequently approved by the Department of Industry, Science and Resources.

What project documentation do I need to keep?

Maintain contemporaneous records such as: technical logs; experiment records; plans; technical investigations; technical objectives; designs; reports; internal meeting minutes, and contracts. 

Can R&D claims be used to raise funding?

Specialist lenders may advance cash against the expected rebate. Evolv3 can provide comfort letters to support these R&D rebate debt-funding facilities.
